As a US employer, do you need to pay employees for COVID vaccine leave?

With vaccines becoming increasingly available, employers may be wondering if they are required to pay their employees for COVID vaccine leave to go get their shot.
The short answer is, it depends. You are required to pay employees for COVID vaccine leave if:

  • You are mandating vaccines for employees;
  • You are a New York employer (up to 4 hours per injection); or
  • You have employees in states with paid sick leave laws (examples: Washington DC and Maryland, depending on your number of employees). Employer-sponsored paid time off plans may also apply.
  • Employers that voluntarily extended Families First Coronavirus Response Act (FFCRA) leave under the new American Rescue Plan Act of 2021 (ARPA) are eligible for tax credits through 9-30-21. The ARPA adds vaccination time and recovery from vaccination complications to FFCRA-covered sick leave.
